Do You Need Council Approval For A Tree Removal?

There are many reasons you might want to remove a tree from your property. Whether your tree is old, blocking your view, or messing with your property line, sometimes you just want it gone. But it isn't always as simple as you might think. 

 

In New South Wales, cutting down a tree without approval can land you in hot water, including some big fines. You could even end up in court! There's no need to panic though - we're going to talk you through exactly what you need to do to get that tree removal approved. While all councils have their own rules, most will automatically approve the removal of the following:

  1. Dangerous or hazardous trees
  2. Fallen or falling trees
  3. Trees in a fire zone
  4. Trees that are very close to a house
  5. Very sick or infested trees

Applying to remove a tree

If you're a renter, you'll need to go through your landlord. Property owners can generally apply online via their council website. If you have more than five trees to cut down, you'll need to call your council directly. When you apply, you should have the following ready to go:


  1. Your address (of course)
  2. A description of the tree
  3. Clear photographs (this can help your application be processed quickly)
  4. Any relevant information about you and your neighbours' properties


You'll also be asked exactly why the tree needs to be removed. If the tree is clearly a danger, the council will approve your application quickly. If a tree is already dead, you may not even need permission (always check your local rules first though).


However, not all applications are approved. Most councils prefer to save trees, so you'll need a good reason. If you just don't like how a tree looks, you're not going to get anywhere. If a tree is blocking your light or disrupting your gardening plans, your council may not care unless it's within three metres of your home. Once you're ready to apply, take the following steps

  1. Go to your local council website
  2. Search for 'tree removal'
  3. Download and complete the application form, making sure to attach those photographs!
  4. Submit your application
  5. Pay any required fees



Depending on where you live, your council may take anywhere from a few days to a few weeks to send an inspector. That's why it's good to send in your application as soon as you notice any problems. Don't delay once you notice problems!
